Terms of Service

1. Definitions

  • Flexys: the platform and associated services as described on flexys.ai.
  • User: any natural person or legal entity that uses the platform.
  • Services: all functionalities offered by Flexys, including website generation, CRM, chatbot, voice agent, calendar and automation.
  • Account: the User's personal access to the platform.
  • Content: all texts, images, data and other materials created or uploaded via the platform.

2. Applicability

These terms of service apply to all use of the Flexys platform and all agreements arising from it. By creating an account or using our services, you agree to these terms. Deviations from these terms are only valid if agreed in writing.

3. Services

Flexys provides an automated platform for setting up and managing business applications. Our services include:

  • AI-generated websites based on business details
  • CRM functionality for customer management
  • AI chatbot and voice agent for customer communication
  • Calendar and booking functionality
  • Workflow automation
  • Online payments for bookings and invoices via Stripe
  • SMS appointment reminders
  • Webcall widget for direct audio calls from the browser
  • Customer portal for viewing and paying invoices
  • Email templates for client communication
  • Email campaigns and marketing automation
  • Knowledge base for FAQs and documentation
  • WhatsApp integration for customer communication
  • Push notifications
  • Voicemail with automatic transcription
  • Webhook integrations with external tools (Zapier, Make)
  • Monthly business statistics via email

We strive for high platform availability but do not guarantee 100% uptime. Planned maintenance will be communicated in advance.

4. Accounts and access

You are responsible for keeping your login credentials confidential and for all activities that take place under your account. If you suspect unauthorized use, you must inform us immediately. We reserve the right to block or delete accounts in case of misuse or violation of these terms.

5. Intellectual property

The platform, software, design and documentation are the property of Flexys and are protected by intellectual property rights. Content created or uploaded by the User remains the property of the User. By uploading content, you grant Flexys a limited license to use this content for delivering the services.

6. Use of AI

Flexys uses artificial intelligence (AI) for generating websites, chatbot responses and phone conversations. AI-generated content is a tool and the User remains responsible for the accuracy and suitability of published content. We do not guarantee that AI-generated content is error-free.

7. Pricing and payment

All plans start with a free 7-day trial. After the trial, the prices listed on the website apply for the chosen plan (Basis, Plus or Pro). All prices include VAT. Payment is made via the payment methods offered on the platform. In case of late payment, we reserve the right to suspend access to the platform. For online bookings where payment is required upfront, payments are processed via Stripe. The customer receives a confirmation after successful payment. Refunds for cancelled appointments are handled according to the individual business owner's policy. SMS appointment reminders are optional and can be enabled or disabled by the business owner.

8. Liability

Flexys is not liable for indirect damage, consequential damage, lost profits or missed savings. Our liability is limited to the amount you have paid us in the 12 months prior to the damage-causing event. We are not liable for damage caused by AI-generated content, incorrect business details or failures by third parties.

9. Termination

You can cancel your account at any time via the platform or by contacting us. Upon cancellation, you can contact us within 30 days to request your data, after which it will be deleted. We reserve the right to terminate the agreement with immediate effect in case of serious violation of these terms.

10. Force majeure

Flexys is not obligated to fulfill any obligation if prevented by force majeure. Force majeure includes: disruptions in internet or telecom infrastructure, power outages, government measures and other circumstances beyond our reasonable control.

11. Changes

We reserve the right to modify these terms. Changes will be communicated at least 30 days before taking effect via email or the platform. If you object to the changes, you can cancel your account before the effective date.

12. Applicable law and disputes

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands. Before submitting a dispute to the court, the parties will endeavor to resolve the dispute through mutual consultation.
